Katy Perry is facing serious allegations that she acted criminally against another celebrity, a charge she flatly denies. But could the location of the accused crime actually mean Perry could face time for the event?

Ruby Rose has publicly accused Katy Perry of egregious and unalwful behavior against her nearly 20 years ago during an alleged incident at a Melbourne nightclub, a claim Perry’s team has strongly denied. According to multiple reports published April 13, 2026, Rose made the allegation in posts on Threads, while Perry’s representative responded by calling the accusation “categorically false” and “dangerous, reckless lies.” The allegation includes the claim that Perry caused Rose to vomit when placing her fully-revealed, lower pelvic body parts onto Rose’s face while she lay, resting nearby.

That denial matters, because at this stage the case exists in the public sphere as an allegation and a rebuttal, not as a criminal filing or a court-tested record. Rose has said publicly that the alleged incident happened long ago in Melbourne and has suggested there were witnesses and other forms of corroboration, but recent reporting also indicates some uncertainty about whether she will actually pursue a formal police complaint. One report said she did not intend to file a legal report, while another said she may now explore whether an official investigation is still possible.

The phrase “statute of limitations” is often used as shorthand for a legal deadline after which a criminal case can no longer be brought. But in this situation, that issue is more complicated than many headlines suggest. In Victoria, where the alleged incident reportedly occurred, historical offences can still be reported, and serious offence matters are not generally treated the same way as minor summary offences with short charging deadlines. Victoria Police maintains channels for reporting historical charges, and Victoria’s legal framework allows old offence allegations to be investigated long after the alleged conduct.

In other words, had this happened in America, the case would likely be closed. But if Ruby Rose wants to pursue it in Australia, where it allegedly occurred, there’s nothing stopping this from going into investigation!

So the cleaner way to explain the law is this: the biggest barrier here may not be a hard time bar in the ordinary sense. The bigger problem is proof. Victoria Legal Aid says prosecutions generally move forward only where there is enough evidence and a reasonable chance of conviction, and it also notes that the sooner an assault is reported, the easier it is for police to investigate and the more likely it is that evidence can support the claim.

That is why, even still, criminal charges against Perry appear unlikely at this point, even though the allegation is extremely serious. A claim tied to an alleged nightclub encounter from almost two decades ago faces obvious evidentiary obstacles: memories fade, witnesses become harder to locate, physical evidence is usually gone, and prosecutors must still prove guilt beyond a reasonable doubt. Victoria’s law reform materials also note that most reported offence matters of this nature do not ultimately end up in court, underscoring how difficult prosecution can be even in more recent cases.

None of that means historical allegations are legally meaningless, and it does not mean police could not assess a complaint if one were filed. It does mean that the public should be careful not to confuse a late public accusation with a case that is likely to result in criminal charges. At the moment, what exists is a very serious allegation from Rose, a total denial from Perry, and a legal reality in which delay does not necessarily bar scrutiny, but often makes prosecution far harder.
